A. Payments & Cancellations

Terms of service

Paradise Fitness Escape lists what is included on the trip’s page.  Airfare, tips, travel insurance, beverages and alcohol is never included.

Reservation

To reserve your place on one our retreat please complete the registration form with the non-refundable deposit specific to your booking date of Paradise Fitness Escape.

Payment

Payment can be made on our online booking system or over bank transfer. Final balances are due 60 days before the starting date of the fitness escape.

Cancellation Policy

If you wish to cancel your booking you must notify Paradise Fitness Escape in writing. Once we’ve received your notice, cancellation will take effect subject to the following:

If cancellation takes place more than 60 days prior to your schedule Fitness Escape date, any payments made will be refunded minus your deposit.

If cancellation takes place between 30-60 days prior to your booking date, 75% of the trip price will be forfeited.

If cancellation takes place less than 30 days prior to your booking date, 100% of the trip price will be forfeited.

Important:  If you do not submit full payment 60 days before the escape, and do not cancel your registration or respond to our communication, Paradise Fitness Escape retains the right to charge the remaining balance due to the credit card provided and release your spot. Any amount forfeited, which has not then been paid to Paradise Fitness Escape by you, will be recovered from you by Paradise Fitness Escape as a debt due and payable. Consider travel insurance to protect the costs of your trip in the case of injury, illness or inability to attend for other reasons.

B. Changes/ Trip Cancellations

Changes:

Paradise Fitness Escape reserves the right to make any changes deemed necessary by our team, trip leaders, trainers or partners. In the event that we need to make a last minute change to the venue, the trainers, the itinerary, or any aspect of the escape due to unforeseen circumstances (natural disaster, illness, civil unrest, death, closure or any other unforeseen circumstance) we will offer the following to our guests that do not want to attend based on changes:

Transfer your deposit to a future escape to be taken within a year from the date of the current escape. All other payments will be forfeited and Paradise Fitness Escape will not be liable for refunding or reimbursing any amount beyond the transfer of the deposit.

If you choose to completely cancel the escape based on the changes, normal cancellation policies apply (see above). Paradise Fitness Escape is not responsible for reimbursing you or refunding you for any amount paid if you decide to cancel based on these changes.

Please note that we require travel insurance so that you can make a claim based on the changes and have some of your expenses reimbursed by the travel insurance that we require for exactly this reason in addition to other medical and travel complications that can occur.

Cancellations:

In the rare case of a cancellation on the part of Paradise Fitness Escape we will offer a transfer to another trip or a full refund of your funds. Paradise Fitness Escape is not responsible for any expenses or damages incurred as a result of trip cancellation including preparation costs, airline tickets, travel documents or other expenses. Paradise Fitness Escape reserves the right to cancel any trip prior to the retreat in the event that there are too few people booked in which case you will be given a full refund of any and all payments made to Paradise Fitness Escape. You will not be entitled to claim any additional amounts or seek any compensation for any injury, loss, expenses or damage (either direct or consequential) or for any loss of time or inconvenience which may result from such cancellation (including but not limited to visa, passport and vaccination charges, or departure, gear purchases, airport and airline taxes).

Due to our need to commit to accommodation and other arrangements in advance, exceptions to our policy cannot be made for any reason.

We do not offer credit for arriving late or leaving early. A guest can change to another retreat 30 days or before your retreat start date on the same destination for a fee Eur 250 with the note that the retreat must have availability.

C. Insurance & Documents

Travel Insurance

Paradise Fitness Escape requires each trip member to purchase individual travel insurance for their trip for both international escapes and domestic escapes. We suggest that you include “cancel for any reason” with your policy.  You must purchase travel insurance that includes medical coverage. We recommend purchase insurance within 1-2 weeks after making your first trip payment (ie. flight or escape reservation) to secure the best price and best coverage. Clients are responsible at all times for their own personal documents, baggage and equipment, whether hired or not.

Travel Documents and Immunizations

It is the responsibility of each traveller to obtain all required travel documents including Visas and other travel documents unless otherwise noted. Information regarding necessary documentation is provided per trip on our website or you can contact us for more detailed information regarding your trip requirements. It is your responsibility to purchase correct immunizations.  Please contact your nearest travel clinic for the latest requirements.

Acknowledgment

Acknowledgment of Risks – Assumption of Responsibility

Although Paradise Fitness Escape has taken reasonable steps ensure safety, I acknowledge that this activity has risks, including certain risks which cannot be eliminated without destroying the unique character of this activity. The same elements that contribute to the unique character of this activity can cause loss or damage to the Participant including accidental injury, illness or in extreme cases, permanent trauma, disability or death and also can cause damage to or loss of property. The following describes some, but not all, of those risks.

Activities vary from trip to trip and may include but are not limited to: in a wide variety of environments including on rock, forest or jungle; bicycling on trails and roads with a wide range of surface conditions and traffic volume; rock climbing, climbing on climbing apparatus and ropes courses, using zip-wires and rope swings; white-water rafting, river kayaking, sea-kayaking and canoeing; swimming, snorkeling and surfing; fishing.

Paradise Fitness Escape can involve travel to remote places, lead to many hours from medical facilities. Transportation, evacuations and medical care can be significantly delayed; communication can be delayed, or limited.

Paradise Fitness Escape does not accept any liability for any problems you encounter while you are travelling to and from the retreat venue, including problems with flights, visas, missed flights or any other matter. It is your responsibility to ensure you have the correct visas, travel documentation and travel vaccinations. All flights and transport arrangements are your responsibility.

Environmental risks and hazards include rapidly moving, deep or cold water; insects, snakes and predators, including large animals; falling and rolling rock; lightning, flash floods and unpredictable forces of nature, including weather which may change to extreme conditions without warning. Possible injuries and illnesses include frostbite, sunburn, heatstroke, dehydration and other mild or serious conditions.

Throughout the trip, participants are responsible for their own safety.

I (the fitness escape participant) acknowledge and understand that Paradise Fitness Escape trips include risks of injury or even death to participants. I understand the description above of these risks is not complete and that other unknown or unanticipated risks may result in property loss, injury or death. I agree to assume responsibility for the inherent risks identified herein and those inherent risks not specifically identified. I acknowledge that participation in this activity is purely voluntary, no one is forcing participation and participation is elected with full knowledge of the inherent risks.

I (the fitness escape participant) assume and accept full responsibility for any injury, death, loss of personal property, and expenses suffered as a result of those inherent risks and dangers identified above, and those inherent risks and dangers not specifically identified and as a result of my negligence in participating in this activity.

Complaints

If you wish to make a complaint or claim whilst staying with Paradise Fitness Escape you must report it to the relevant representatives, thereby giving them the opportunity to remedy the problem. We cannot accept any liability whatsoever if we are not informed immediately, of any problem during your stay. Complaints not resolved completely whilst on the escape should be made in writing within 28 days of the end of the holiday. We will not accept liability for claims received after this period.

D. Waiver (Release and Waiver of Liability)

Declaration of health

By accepting this Tour Participant Agreement I (the fitness escape participant) represent that I have no physical conditions or medical precautions which would adversely affect my ability to take part in the yoga/fitness program or other physical, cultural or adventurous activities offered on Paradise Fitness Escape. I fully understand that my participation in the yoga/fitness program or other activities could be injurious to my health and I voluntarily assume all risks related to such activities.

Disclaimer

Paradise Fitness Escape does not accept any liability for theft or damage to personal possessions; any costs, cancellations, delays or changes as a result of fire, natural disaster, problems with transport, or any other events beyond our control; personal injuries or medical conditions that develop during or after the retreat.

I am aware that the escape involves many inherent risks, dangers and hazards, including, but not limited to the use and operation of surfboards, impact of collision with surfboards including the fins and other attachments; skin irritations or abrasions caused by the use of wet suits; ear infections caused by the water; impact to the beachhead, or, as the case may be, the ocean floor; severe weather conditions; my ability to swim in dangerous ocean conditions, as the case may be; extreme water and air temperatures; the prevailing condition of the surf; undertow and tide; the possible existence of dangerous rocks, reefs, driftwood, logs, floating objects, sea and land animals and insects and other hazards and obstructions, whether marked or unmarked in the area chosen by Paradise Fitness Escape to conduct beach trips, yoga activities, outdoor activities, and surfing; impact of collision with swimmers or other surfers or their surfboards, whether or not caused by negligence of such swimmers or surfers; dangers involved in traveling to the beach areas, yoga area, surfing area and any activities whilst at a Paradise Fitness Escape destination, including possible transportation provided by the Paradise Fitness Escape parties and hazards involved in reaching the destination by boat, automobile and foot; whether or not caused by negligence on the part of the Paradise Fitness Escape.

I am also aware that I will be eating food and drinking water and beverages that may make me ill, sick and may cause death. I freely accept and fully assume all such risks, dangers and hazards and associated with eating and drinking food and beverages at a Paradise Fitness Escape destination and those provided by the Paradise Fitness Escape.

I am also aware that I am participating in yoga instruction during which I will receive information and instruction about yoga, exercise, meditation, and health. I recognize that these activities require physical exertion that may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved.

I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the Retreat. I represent and warrant that I am physically fit and I have no medical conditions that would prevent my full participation in yoga and additional Retreat activities.

In consideration of being permitted to participate in the escape, I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating in the retreat, including any and all activities done with the escape group, or as an individual.

I am also aware that I am participating in activities such as sailing, swimming, hiking, zip-lining, repelling, hiking, dining, quad biking and other activities. I recognize that these activities involve risks and require physical exertion that may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved.

In consideration of Paradise Fitness Escape agreeing to provide me with possible transportation (by land, foot, air, or water), lodging accommodations, dining, surfing, quad-biking, repelling, hiking, yoga instruction, surf instruction, supervision and training, and any other services provided, whether provided directly by Paradise Fitness Escape or third parties with whom Paradise Fitness Escape have contracted (which together are referred to as “Provided Services”), as part of the retreat I have applied for with Paradise Fitness Escape, I freely accept and fully assume all such risks, dangers and hazards and the possibility of personal injury, death, property damage or loss resulting from such risks, dangers, and hazards.

The undersigned also agrees as follows:

To assume and accept all risks, dangers and hazards in connection with my use of any and all services provided by Paradise Fitness Escape.
To waive any and all claims that I may have against Paradise Fitness Escape, its owners, principals, agents, employees and representatives.
To release the Paradise Fitness Escape from any and all liability for any loss, damage, injury or expense that I, or my next to kin, may suffer or incur as a result of my use of the Services due to any cause whatsoever, including negligence on the part of the Paradise Fitness Escape;
To hold harmless and indemnify the Paradise Fitness Escape from any and all liability for property damage, personal injury or death suffered by myself or by a third party as a result of my use of the provided Services;
That this release and indemnity agreement shall be effective and binding on my heirs, next to kin, executors, administrators, and assigns, in the event of my death;
To obey all warnings, safety instructions, cautions and other notices provided to me by The Paradise Fitness Escape;
The Paradise Fitness Escape representatives, have the right to refuse to provide me with Provided Services related to surfing or participating in activities in the ocean, if, in the opinion of the Paradise Fitness Escape, the undersigned’s swimming abilities, health or the prevailing weather conditions could render it dangerous or unsafe to use such Services;
To hereby grant Paradise Fitness Escape an unrestricted right to use and publish photographs and/or video and film taken of me while participating in programs offered by The Paradise Fitness Escape, for editorial, trade, social media, and any other professional purpose, in any manner and medium, and to copyright the same. Furthermore, I hereby release and discharge the Paradise Fitness Escape from any and all claims relating to said photographs and/or film and use of my image and/or likeness for the purposes identified herein

As a condition of booking on a Paradise Fitness Escape, I agree to all terms and conditions as stated above. All participants in Paradise Fitness Escape must have suitable travel insurance.

Personal Release

By agreeing to the terms outlined here and elsewhere on the Paradise Fitness Escape website I hereby release and discharge my rights and claims for damages or liabilities that may occur as a result of participation on a Paradise Fitness Escape trip, including but not limited to damages as a result of unexpected occurrences including those from weather, local political situations, wildlife or uncontrollable acts of God, including the risk of death. I release Paradise Fitness Escape including its owners, directors, employees, guides, instructors and partners from liability for personal injury, illness, emotional damage, incurred travel expenses or property damage I may incur as a result of participation on this trip.

For the benefit of everyone on your trip, Paradise Fitness Escape reserves the right to accept or reject any participant at any time without liability, and in the event it determines, in its sole and exclusive discretion, that a participant is disruptive to the harmony of the trip, it may without any obligation to pay a refund or any other amount whatsoever, expel such participant from the trip. Paradise Fitness Escape will carry no responsibility or liability for any participant who leaves the trip prior to its conclusion or for any activity undertaken by any participant which is not included on the escape itinerary.
